5.6.2 Non-discrimination policies for transgender

Have a policy of non-discrimination for transgender people.
In order to implement guidelines at Prince of Songkla University (PSU) in line with the principles of gender equality for its staff and students, and in accordance with the principles outlined in the Constitution of the Kingdom of Thailand B.E. 2560 (2017) and the Gender Equality Act B.E. 2558 (2015), PSU hereby issues the following declaration:
Announcement of Gender Equality Guidelines for Staff and Students at Prince of Songkla University B.E. 2567 (2024)
Pursuant to Sections 34 and 39 of the Prince of Songkla University Act B.E. 2559 (2016), and the decision of the PSU Executive Board in Meeting No. 10/2567 on October 1, 2567 (2024), PSU issues the following announcement on gender equality practices for its staff and students:
This announcement shall be known as the "Announcement on Gender Equality Guidelines for Staff and Students at Prince of Songkla University B.E. 2567 (2024)."
This announcement shall be effective from the day following its publication.
In this announcement:
- "University" refers to Prince of Songkla University.
- "President" refers to the President of Prince of Songkla University.
- "Departments" refers to the University Council Office, the President’s Office, campus offices, faculties, colleges, institutes, centers, or other equivalent units.
- "Staff" refers to university personnel, government officials, employees in public service at the university, and university employees at Prince of Songkla University.
- "Student" refers to students at Prince of Songkla University.
- "Gender Identity" refers to the gender expression, actions, or roles of a person which may or may not correspond with their birth sex.
- "Birth Sex" refers to the sex assigned at birth based on physical or anatomical characteristics.
All staff and students, regardless of birth sex, gender identity, or gender expression, shall treat each other with respect for human dignity and gender equality, without engaging in bullying, discrimination, disrespect, exploitation, harassment, or devaluation of individuals based on gender or gender identity, directly or indirectly, including any biased actions that infringe on individual rights and freedoms.
Staff with a gender identity different from their birth sex are permitted to wear attire matching their gender identity when participating in official ceremonies or performing work duties.
Students with a gender identity different from their birth sex are entitled to wear university uniforms that align with their gender identity, including during university ceremonies, except for practical or internship courses, which will follow the attire requirements of the relevant department or workplace. For graduation ceremonies, students with a gender identity different from their birth sex may wear graduation attire that aligns with their gender identity.
Staff and students with a gender identity different from their birth sex may use a photograph that reflects their gender identity in official ID cards or documents.
Announcements regarding staff recruitment and qualifications or prohibitions for candidates for university staff or student status shall not specify gender identity as a qualification or prohibition.
Departments are prohibited from issuing announcements, regulations, or guidelines that discriminate unjustly against staff or students with a gender identity different from their birth sex.
The university or departments shall establish a channel for reporting suspected incidents or complaints of conduct violating these guidelines and shall maintain confidentiality regarding any individual information involved.
In cases of incidents or complaints of violations of these guidelines, the university or department shall promptly pursue fact-finding, investigation, and actions to provide fair treatment to individuals affected by such violations.
The President shall be responsible for enforcing this announcement and shall have the authority to establish rules and procedures for implementing this announcement. In cases of questions or uncertainties about compliance with this announcement, or when exceptions are necessary, the President shall have the final authority to decide.
